Man With a Van Richmond Service Terms and Conditions

These Terms and Conditions set out the basis on which Man With a Van Richmond provides man and van, removal and related transport services. By making a booking, accepting a quotation or allowing work to commence, you agree to be bound by these Terms and Conditions.

Definitions

In these Terms and Conditions, the following expressions shall have the meanings given below:

Client means the person, company or organisation requesting or paying for the services.

Services means any man and van, removal, packing, loading, unloading, transport, delivery, waste removal or related services provided by Man With a Van Richmond.

Goods means any items, furniture, belongings or materials handled, transported or stored in connection with the Services.

Vehicle means any van or other vehicle operated by or on behalf of Man With a Van Richmond.

Contract means the agreement between the Client and Man With a Van Richmond incorporating these Terms and Conditions.

Scope of Services

Man With a Van Richmond provides man and van and small removal services within Richmond and surrounding areas, with journeys that may start or end elsewhere in the United Kingdom as agreed at the time of booking. The exact scope of the Services, including pick-up and drop-off locations, number of operatives, vehicle size and any additional services, will be set out in the quotation or booking confirmation.

Quotations and Pricing

Quotations are based on the information supplied by the Client, including but not limited to the addresses, access conditions, number and nature of items, and any special handling requirements. Quotations may be provided as fixed price or as an hourly rate, and this will be clearly identified at the time of booking.

Man With a Van Richmond reserves the right to amend the quotation or charge additional fees where:

The information provided by the Client was incomplete, inaccurate or has changed.

Access to the property is restricted, hazardous or significantly different from what was described.

Additional items, extra floors, extended walking distances or delays outside the control of Man With a Van Richmond occur.

Waiting time becomes necessary due to delays caused by the Client or third parties, such as key collection, paperwork, or loading restrictions.

Unless otherwise stated, prices do not include congestion charges, tolls, parking charges, ferry charges, or any other local authority or third-party fees. These shall be payable by the Client where incurred.

Booking Process

A booking is only confirmed when Man With a Van Richmond has accepted the Client's request for Services, which may be done verbally or in writing, and, where required, when any requested deposit has been received.

The Client must provide accurate details of:

Collection and delivery addresses.

Dates and times required.

Approximate inventory of items to be moved.

Parking availability and access conditions, including floor levels, lift access, staircases, and any time restrictions.

Any items requiring disassembly, special handling or protection.

Man With a Van Richmond may refuse or cancel a booking where it considers the work unsafe, unlawful, or beyond its practical capacity.

Client Responsibilities

The Client is responsible for:

Ensuring that suitable and legal parking is available at both collection and delivery points. Any penalties or charges arising from insufficient or illegal parking caused by the Client's instructions will be added to the final invoice.

Ensuring that all Goods are properly packed and prepared for transport unless packing services have been specifically agreed.

Removing all personal and valuable items such as money, jewellery, documents, electronic devices and other items of high value before the move, unless specifically agreed in writing.

Being present or represented at the collection and delivery addresses to direct the operatives and check the Goods. Where the Client is not present, the Services will be carried out as reasonably determined by the operatives, and Man With a Van Richmond shall not be liable for any loss arising from this arrangement.

Securing necessary permissions or permits for parking, building access, loading areas and use of lifts where required.

Payments and Charges

Payment terms will be communicated at the time of booking. Man With a Van Richmond may require payment in advance, a deposit, or payment in full on completion of the Services, depending on the nature and scale of the work.

Payments must be made by the methods accepted by Man With a Van Richmond. All amounts are payable in pounds sterling unless otherwise agreed in writing.

Where Services are charged at an hourly rate, the minimum hire period and charging increments will be agreed prior to the commencement of the Services. Time is typically charged from the agreed arrival time or actual arrival time, whichever is later, until completion of unloading or the end of the agreed hire period.

Where payment is not made on time, Man With a Van Richmond reserves the right to:

Charge interest on overdue amounts at the statutory rate until payment is received in full.

Retain possession of Goods until payment is made, subject to applicable law.

Cease or suspend further Services for the Client.

Cancellations and Changes

The Client may cancel or amend a booking by providing notice to Man With a Van Richmond. Any cancellation or change must be communicated as early as possible.

Man With a Van Richmond reserves the right to apply cancellation or rescheduling fees, which may include:

No charge for cancellations made with reasonable notice in advance of the scheduled date, as specified at the time of booking.

A proportion of the quoted price where cancellation is made at short notice.

Up to the full quoted price where cancellation occurs on the day of the move or upon arrival at the property.

If the Client reduces the scope of the Services at short notice, Man With a Van Richmond may, at its discretion, charge based on the original booking if alternative work cannot be secured for that time.

In the event that Man With a Van Richmond must cancel or amend the booking due to circumstances beyond its control, including but not limited to vehicle breakdown, severe weather, accidents, illness, or operational issues, it will inform the Client as soon as reasonably practicable and seek to offer an alternative date or time. Man With a Van Richmond shall not be liable for any indirect or consequential losses arising from such cancellation or rescheduling.

Goods Not Accepted for Transport

Unless expressly agreed in writing before the Contract is made, Man With a Van Richmond does not carry or handle:

Illegal items, stolen goods or items obtained unlawfully.

Explosives, ammunition or weapons.

Flammable or hazardous materials, including gas cylinders, fuels, chemicals, paints and solvents.

Live animals, plants that may be prohibited, or perishable goods requiring special storage conditions.

Precious metals, jewellery, watches, cash, securities, important documents or items of exceptional value.

If such items are transported without disclosure and prior written agreement, Man With a Van Richmond accepts no liability for loss, damage or delay relating to them, and the Client shall indemnify Man With a Van Richmond against any resulting claims, fines or losses.

Packing, Loading and Access

Where the Client undertakes their own packing, it is their responsibility to ensure items are securely packed in suitable containers. Man With a Van Richmond shall not be liable for damage arising from poor or inadequate packing by the Client.

The Client must ensure safe and reasonable access to the property, including sufficient space to load and unload the Vehicle, clear stairways, corridors and lifts, and safe floor surfaces. Man With a Van Richmond may refuse to move Goods where it reasonably considers that doing so may cause damage to the property, the Goods or pose a safety risk to operatives or others.

Any dismantling or reassembly of furniture or equipment will only be carried out where specifically agreed and may be subject to additional charges. Man With a Van Richmond does not accept responsibility for damage resulting from the inherent weakness of, or defects in, assembled or flat-pack furniture.

Liability and Limitations

Man With a Van Richmond will exercise reasonable care and skill in providing the Services. However, liability is subject to the limitations set out in this section.

Man With a Van Richmond shall not be liable for:

Loss or damage arising from the Client's failure to adequately protect, pack or secure Goods.

Damage to items that are already defective, fragile, or unsuitable for transport.

Loss or damage caused by wear and tear, gradual deterioration, infestation or inherent vice of the Goods.

Loss of data or records stored on computers, devices or media.

Indirect or consequential losses, including loss of profit, loss of opportunity, or loss of enjoyment.

Any delay or failure to perform caused by circumstances beyond its reasonable control, including but not limited to road traffic conditions, accidents, weather events, strikes, or acts of third parties.

Liability for loss of or damage to Goods, where established, may at the discretion of Man With a Van Richmond be limited to the reasonable cost of repair or replacement, taking into account age, condition and market value, and may be subject to an overall financial cap per job. Details of any applicable caps or insurance cover may be provided upon request.

The Client must notify Man With a Van Richmond in writing of any visible loss or damage as soon as reasonably possible and in any event within a reasonable period after completion of the Services. Failure to report within this period may affect the ability to investigate and resolve the matter.

Waste, Rubbish and Recycling Regulations

Man With a Van Richmond operates in accordance with applicable waste and environmental regulations. Where the Services include the removal or disposal of unwanted items, rubbish or waste, the following terms apply:

Only waste types that are lawfully permitted will be collected. Hazardous, clinical, chemical or restricted waste types will not be removed unless expressly agreed and arranged with an appropriately licensed facility.

The Client is responsible for accurately describing the nature and contents of any items to be disposed of. Any additional costs incurred as a result of undeclared or misdescribed waste will be charged to the Client.

Where possible, reusable items may be directed for donation or recycling, but no guarantee is given that any specific items will be reused or recycled.

Man With a Van Richmond will not be responsible for any items left behind that the Client later wishes to keep. The Client must clearly identify which items are to be removed as waste and which are to be moved or retained.

Insurance

Man With a Van Richmond maintains insurance cover appropriate to its operations, subject to the terms, conditions and exclusions of the relevant policies. This may include public liability insurance and cover for Goods in transit. Details of cover can be provided upon request.

It is the responsibility of the Client to arrange additional insurance for high-value items or where the value of the Goods exceeds any stated liability limits. Man With a Van Richmond does not provide or arrange insurance contracts for the Client.

Complaints and Dispute Resolution

If the Client is dissatisfied with any aspect of the Services, they should notify Man With a Van Richmond as soon as possible so that the matter can be investigated and, where appropriate, rectified.

Man With a Van Richmond will use reasonable efforts to resolve complaints promptly and fairly. Where a dispute cannot be resolved directly, the parties may consider mediation or another form of alternative dispute resolution before commencing legal proceedings, although this is not mandatory.

Privacy and Data Protection

Man With a Van Richmond will collect and process personal data only as necessary to provide the Services, manage bookings, process payments and comply with legal obligations. Personal data will be handled in accordance with applicable data protection laws. Client details will not be sold to third parties. Information may be shared with operatives, insurers, payment providers or authorities where required for the performance of the Contract or by law.

Variation of Terms

Man With a Van Richmond may update or vary these Terms and Conditions from time to time. The version in force at the time of booking will apply to that Contract. Any variation to these terms requested by the Client shall only be valid if agreed in writing by an authorised representative of Man With a Van Richmond.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court or competent authority, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, the Services or the Contract shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

By proceeding with a booking or allowing work to commence, the Client confirms that they have read, understood and agreed to these Terms and Conditions.
